LIMITED WARRANTY AND DISCLAIMER Screenflex Portable Partitions Inc. (“Screenflex”) warrants to the purchaser for three (3) years from the date of shipment that the Multi-Purpose Ballistic Panel (the “Product”) is free of defects in materials and workmanship. EXCEPT FOR THE FOREGOING LIMITED WARRANTY, SCREENFLEX MAKES NO OTHER WARRANTY WHATSOEVER WITH RESPECT TO THE PRODUCT, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, WHETHER EXPRESS OR IMPLIED BY LAW, COURSE OF DEALING, COURSE OF PERFORMANCE, USAGE OF TRADE OR OTHERWISE. The Product has been tested in certified laboratory conditions in accordance with the standards set by Underwriters Laboratories (“UL”) and the National Institute of Justice (“NIJ”) for ballistic-resistant protective materials. The Product cannot and will not protect against higher-power weapons or ammunition. Ballistic protection can never be 100% guaranteed – the Product is “bullet-resistant,” not “bulletproof.” WHILE THE PRODUCT MEETS THE PERFORMANCE LEVELS OF UL 752 LEVEL 3 AND NIJ STANDARD 0108.01 TYPE III-A, SCREENFLEX SHALL IN NO EVENT BE LIABLE FOR ANY PERSONAL INJURIES (INCLUDING DEATH) SUSTAINED BY PERSONS USING THE PRODUCT. IN NO EVENT SHALL SCREENFLEX BE LIABLE TO THE PURCHASER OR ANY THIRD PARTY FOR ANY CONSEQUENTIAL, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES WHETHER ARISING OUT OF BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, REGARDLESS OF WHETHER SUCH DAMAGES WERE FORESEEABLE AND WHETHER OR NOT SCREENFLEX HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
